No Return Policy

1. Acceptance of Terms

By completing a purchase on the Site, the purchaser (“you”) agrees that all sales are final and that this No Return Policy (“Policy”) forms part of the binding contract between you and JamRoQ Marketplace(“we,” “our,” “us”). Nothing in this Policy limits any non-waivable rights provided by applicable U.S. federal or state law.

2. All Sales Final

Except as required by law and as set out in Section 3 below, we do not accept returns, exchanges, cancellations, or issue refunds for any products or services sold through the Site.

3. Limited Statutory Exceptions

Where federal or state law grants you a non-waivable remedy, you must notify us within the time frames below:

If your claim is valid, we will, at our sole discretion, repair, replace, or refund the affected item. Shipping costs are non-refundable unless otherwise required by law.

4. How to Submit a Statutory Claim

  • Order number and date
  • Item(s) in question
  • Description of the issue and supporting evidence
  • Preferred remedy (repair, replacement, or refund)

Retain all original packaging until your claim is resolved; discarding it may void your claim.

5. Non-Returnable & Non-Refundable Items

Regardless of Section 3, we never accept returns or provide refunds for:

  • Digital downloads, software keys, or gift cards once delivered or accessed
  • Personalized, custom-made, or perishable goods
  • Items marked “final-sale,” “as-is,” or “non-returnable” on their product page
  • Services already rendered (e.g., consulting, installation)
  • Products used, altered, washed, or damaged after delivery

6. Risk of Loss & Title

Title and risk of loss pass to you when we hand goods to the carrier. You are responsible for filing claims with the carrier for packages lost or damaged in transit.

7. Chargebacks & Payment Disputes

Initiating a chargeback or other payment dispute before following the procedure in Section 4 violates this Policy. We reserve the right to collect any amounts owed, plus reasonable collection costs and attorneys' fees, as allowed by law.

8. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages. Our maximum aggregate liability will not exceed the purchase price you paid for the item giving rise to the claim.

9. Governing Law & Dispute Resolution

This Policy—and any dispute, claim, or controversy arising out of or relating to it—shall be governed first by applicable federal law of the United States, including the Federal Arbitration Act where relevant. If and only to the extent federal law does not supply a rule of decision, the laws of the U.S. state in which the purchaser resides at the time of purchase will apply, without regard to that state's conflict-of-law principles. Any litigation that is not subject to arbitration may be brought in any federal or state court of competent jurisdiction within the United States, and each party irrevocably submits to the personal jurisdiction of such courts.

10. Severability

If any provision of this Policy is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

11. Modifications

We may modify this Policy at any time by posting an updated version on the Site.
